Connect Adventures Pty Ltd – Terms and Conditions

By confirming your booking with Connect Adventures Pty Ltd (ABN 25 682 221 147) (Connect Adventures) for any tour, you agree to the terms and conditions outlined below. Please read them carefully before proceeding with your booking.

  1. Bookings and Payments
  • A deposit of 25% of the total tour price is required to secure your booking.
  • The remaining balance is due 45 days prior to the scheduled tour departure.
  • If the remaining balance is not paid by the due date, your booking will be cancelled, and the deposit will be forfeited.
  • Bookings made within 45 days of the tour departure date require full payment at the time of booking.
  • Tour confirmations are subject to minimum group size requirements to proceed.
  1. Tour Itinerary and Changes
  • The tour itinerary, including transfer routes, walking routes, and campsites, may be modified due to weather conditions, local circumstances, or other unforeseen events.
  • Changes may also occur based on group dynamics and interests.
  1. Cancellation, Refunds, and Transfers

Cancellation or Transfer by you

  • Deposits are transferable to another available Connect Adventures tour date if written notice is received before the final payment date.
  • If you cancel within 45 days of the departure date, 100% of the tour price will be non-refundable however you may be able to transfer your booking.
  • If you fail to arrive at the prearranged meeting place at the relevant time communicated to you, you will not be eligible for a refund.
  • If you choose to leave the tour for reasons outside of Connect Adventures’ control, no refund will be provided.
  • Transfer requests to another tour or date before the final payment date may incur a $100 fee. The new tour price will be based on the current price at the time of the transfer request, and additional charges may apply.
  • Transfer requests less than 45 days before departure will not be accepted, and standard cancellation policies above will apply.

Cancellation or transfer by Connect Adventures

  • If Connect Adventures needs to cancel a tour due to fire, weather or other factors beyond our control, guests will be offered a transfer to another available date.
  • Connect Adventures strongly recommends you obtain comprehensive travel insurance to cover cancellation, personal injury, medical, and other related expenses.
  1. Health, Fitness, and Medical Information
  • All participants must disclose any medical conditions, injuries, or allergies that could affect their ability to safely participate in the tour. If required, participants must submit a medical clearance form from a qualified medical practitioner.
  • Participants are responsible for ensuring they have adequate medication for the entire duration of the tour.
  • Connect Adventures reserves the right to cancel bookings if an undisclosed medical condition is deemed a safety risk to the participant or others.
  • Due to the physical nature of the tours and to assist with safety, guests aged over 69 years of age must provide medical clearance from a qualified medical practitioner on Connect Adventures’ clearance form.
  • Physical preparation is essential. If a participant is deemed unfit or unprepared, they may be asked to miss certain days of the trek to ensure the safety of the individual and the group.
  1. Minors
  • Tours are designed for adults, but minors aged 16 years and older may participate, provided they are accompanied by a parent or guardian.
  • For those under 16 years old, please contact us directly to inquire about possible participation.
  1. Your Acknowledgement of risk and responsibilities

By booking and participating in any tour with Connect Adventures, you acknowledge and agree to the following:

  1. Acknowledgement of Risk: Participation in Connect Adventures’ tours involves inherent risks, including but not limited to the following:
    • Rugged terrain and wilderness areas
    • Physical exertion beyond individual preparation
    • Extreme weather conditions and sudden changes
    • Remoteness from medical services and difficulties with evacuation
  1. Fitness: you declare that:
    • you are medically and physically fit to participate in the tour. You must notify Connect Adventures if your condition changes before or during the tour; and
    • If you are under treatment for any physical disorder, ailment, or other illness, your medical care provider has approved your participation in the tour.
  1. Medical Treatment: You consent to receiving first aid, medical treatment, or evacuation assistance if necessary, during the tour. You agree to reimburse Connect Adventures for any associated costs.
  2. Weather and Conditions: You understand that weather conditions can change unexpectedly, which may result in tour changes, delays, or cancellations.
  3. Travel Insurance: Connect Adventures strongly recommends you obtain comprehensive travel insurance to cover cancellation, personal injury, medical, and other related expenses.
  4. Behaviour on tour: Connect Adventures and its staff take their responsibilities seriously and may, at their option, cancel your participation in any tour if for any reason a tour leader believes, in their reasonable discretion, that you should not participate, including if:
    • you breach these terms and conditions;
    • you behave in a way that is inappropriate or offensive or commit an illegal act; or
    • in the reasonable opinion of the tour leader, you behave in a way that causes or is likely to cause danger, distress or annoyance to others, and you must follow the tour leader’s instructions if directed not to continue in the tour.
  1. Other responsibilities – You also agree that:
    • you have sole responsibility for your personal possessions before, during and after any tour; and
    • you must follow the instructions of Connect Adventures and its staff at all times in connection with any tour, including proper use of any safety equipment provided.
  2. Indemnity – You indemnify Connect Adventures (and our staff) against any claims, loss or damage incurred by us in connection with your behaviour on tour, including your treatment of others or your failure to comply with a tour leader’s reasonable instructions, except to the extent any claims, loss or damage are caused by Connect Adventures or its staff.
  1. Liability and Australian Consumer Law
  1. General liabilities

To the maximum extent permitted by law, unless expressly provided in these terms and conditions, all implied terms, conditions, warranties and any other additional obligations are excluded from these terms and conditions. If any legislation implies into these terms and conditions any term, condition, warranty or additional obligation that cannot be lawfully excluded (Non-Excludable Guarantee), then that term, condition, warranty or additional obligation will be included in these terms and conditions only to the extent required by the relevant legislation, but each party’s liability in respect of any breach of that term, condition, warranty or additional obligation will be limited to the maximum extent (if any) permitted by that legislation.

Where Connect Adventures is bound by a Non-Excludable Guarantee, but is permitted to limit its liability under that Non-Excludable Guarantee, then to the extent permitted by law, Connect Adventures’ sole liability for breach of contract, breach of statutory duty, breach of a condition, warranty, guarantee, negligence, or other tort or other obligation implied by law is limited to any one of the following as we decide:

    • in the case of goods, the repair or replacement of the goods or the supply of equivalent goods (or a refund of the amount paid for the goods); and
    • in the case of services, the supplying of the services again (or a refund of the amount paid for the service).
  1. Australian Consumer Law & Recreational Activities

You agree that each activity within a tour constitutes a recreational service within the meaning of section 139A of the Competition and Consumer Act 2010 (Cth) (CCA) as each activity within a tour is:

    • a sporting event or similar leisure time pursuit; and/or
    • other activity that involves a significant degree of physical exertion or physical risk and is undertaken for the purpose of recreation, enjoyment or leisure.

The CCA implies certain Non-Excludable Guarantees into contracts for the supply of certain goods and services, for example, that goods or services will be rendered with due care and skill, that goods or services supplied will be reasonably fit for purpose and that goods or services will be delivered in a timely manner.

Under section 139A of the CCA, we are entitled to ask you to agree (and you hereby agree) that:

    • these Non-Excludable Guarantees relating to the supply of services do not apply to you to the extent that you suffer from death, physical or mental injury, disease or any other condition or circumstance that may cause you harm; and
    • you will take no course of action against Connect Adventures or its staff if you are killed or injured because any one or more activity during the tour was not provided in accordance with the Non-Excludable Guarantees.

Note: these changes to your rights as set out in this clause, do not apply if your death or injury is due to reckless conduct by Connect Adventures. ‘Reckless conduct’ means any conduct where Connect Adventures is aware, or should reasonably have been aware, of a significant risk that the conduct could result in personal injury to another person and engages in the conduct despite the risk and without adequate justification.

  1. Privacy

You permit Connect Adventures to collect personal information from you regarding your health and any medical conditions. You acknowledge that this personal information will be disclosed to tour leaders and other representatives in order to ensure your safety and wellbeing but will not be used by them for any other purpose.

Our Privacy Policy contains information about how you may access, update and seek correction of the personal information we hold about you and how you may complain about any potential breach by us of any Australian privacy laws and how such complaints will be dealt with.

By agreeing to these terms and conditions you consent to photographs and video recordings being made of you during the tour. You also agree to your name, image, voice or likeness being used without charge by Connect Adventures for promotional purposes, including but not limited to website, printed promotional items and promotional presentations, unless you notify us in writing that you do not wish to have your image to be used for these purposes.

  1. Force Majeure

Connect Adventures will not be liable for any failure to perform its obligations under these terms and conditions if the failure arises from circumstances beyond its reasonable control. Such circumstances include, but are not limited to:

  • Fire
  • Explosion
  • Industrial disputes
  • Government actions
  • Failure or refusal of a supplier to supply goods
  • Floods
  • Other “Acts of God” (natural disasters, severe weather events, etc.)

In the event of a Force Majeure situation, Connect Adventures shall not be held liable for any damages arising from late performance or failure to perform. The participant agrees that no claims for damages shall be made due to delays, cancellations, or changes caused by Force Majeure events.

  1. General

You must not assign, sublicense or otherwise deal in any other way with any of your rights under these terms and conditions.

If a provision of these terms and conditions is invalid or unenforceable it is to be read down or severed to the extent necessary without affecting the validity or enforceability of the remaining provisions.

Each party must at its own expense do everything reasonably necessary to give full effect to these terms and conditions and the events contemplated by it.

These terms and conditions are governed by the laws of NSW and each party submits to the jurisdiction of the courts of NSW.
